May 2021 – Investor Requirements for an EB-5 Green Card and E-2 Visa

EB-5 Green Card Investor Eligibility Criteria

  • Investor can be from any country but must have no criminal record.
  • 18+ years of age to subscribe individually. Minor children under 18 can subscribe with parental consent.
  • Investor must be an accredited investor, however funds can be gifted to a non-accredited investor from an accredited gift or.Additional documentation from the gift or required.
  • Must be able to invest a minimum of $900,000 for 5 – 7 years in a Targeted Employment Area (‘’TEA’’) Project, or $1.8 million in anon-TEA based Project.
  • All investment funds must come from a traceable lawful source.
  • An investor’s spouse and any unmarried children under 21 can all receive an EB-5 green card under one investment.
  • No business experience required for EB-5 investor applicant.
  • Investor can live or work anywhere in the United States.
  • Investment remains at risk; however, investor capital plus a small return should be returned to the investor subject to the success of the Project in 5-7 years.
  • EB-5 green card holders must not be outside the United States for prescribed timeframes each year and trailing 36 months.

E-2 Visa Investor Eligibility Criteria

  • Investor must be from, or have a valid passport issued by, a U.S. E-2 Treaty country.
  • Certain Treaty countries offer Citizenship by Investment options for those not from a Treaty country, that then make you eligible for an E-2 Visa application.
  • Investor must make a substantial investment in an active for-profit U.S.-based business. Funds cannot sit in a U.S. bank account.
  • There are no specific investment requirements, however investors should expect to invest a minimum of $100,000 and demonstrate employment of U.S. persons.
  • Investor must have at least a fifty percent ownership stake in the US business and/or demonstrate existence of operational control.
  • Investors may purchase an existing business, a franchise or set up their own company in virtually any sector.
  • Investor must develop or direct the business.
  • Investment cannot be ‘’margin’’ meaning, the enterprise must create a significant impact on the U.S. economy or generate considerably more income than just a living for the investor and their family.
  • An investor’s spouse and any children under 21 are also eligible for an E-2 visa under one investment.
  • Limited business experience needed from E-2 investor applicant.
  • Investor must live near the E-2 business investment.
  • The business must remain operating and profitable in order for E-2 visa to be renewed (renewal time periods range from 1 – 5years).
