What is the EB-1C Green Card

• This is a first preference employment-based immigrant Green Card for those seeking to work in the United States in a managerial or executive capacity and who have been employed abroad with the same employer, an affiliate or subsidiary of the employer

• No labor certificate is required Family of EB-1C candidate

• Spouse and unmarried children under 21 are derivative beneficiaries of an approved EB-1C petition

Candidate Credentials

• Must have been employed for at least one year within the past three years preceding filing the petition by the same multinational corporation, an affiliate, parent, branch, or subsidiary of the company

• The candidate must continue to seek to render services to the same employer in a managerial or executive capacity

• Designed for the most skilled foreign managers and executives

• A job offer is required with the EB-1C petition

 

Employer Credentials

• Must conduct business in the United States and U.S. company must have been in existence for at least one year

• Must file petition for the manager or executive

• Must provide evidence and a cover letter that describes the position offered to the foreign manager or executive in the U.S., name of foreign employee, position held abroad and proof the U.S. employer has been doing business for at least one year prior to filing the petition

How to obtain an EB-1C Green Card

• Adjustment of Status from an L-1A to an EB-1C

• If located outside the U.S., processing must be done abroad at a U.S. consulate via filing a form I-140 Processing Times & Filing Fees

• Approximately six months and $700 to file form I-140
